Vaccine Mandate Update

Just to close the door on your questions about the vaccine mandate, the US Supreme Court on January 13, 2022 prohibited OSHA from enforcing the mandate for employers with more than 100 employees. The majority of the Court concluded Covid-19 is not an occupational hazard in many workplaces. The Court did acknowledge there may be crowded or cramped workplaces that pose special dangers, but did not define those.

There are at least two takeaways from this ruling. First, the Court left open more targeted regulations for a particular workplace or job, such as the crowded or cramped workplaces. Secondly, while there is now no nationwide requirement, it does not impact the validity of state or local regulations or requirements imposed by private businesses.
